The SDUSD PSA
A Project Stabilization Agreement (PSA) is a legally binding contract between San Diego Unified School District (SDUSD), San Diego Building & Construction Trades Council and Southwest Regional Council of Carpenters. It establishes a standard for a contractor’s relationship with his/her workers by setting basic standards for hiring, dispute resolution, payment of fringe benefits, and utilization of apprentices, among other things. These basic standards come from the labor unions.
The PSA is designed to ensure a sufficient supply of skilled craft workers and eliminate work disruptions on Propositions S and Z projects. The Agreement contains sections describing the process for referral & hiring of journeyman workers and apprentices, for resolving disputes, and for promoting local hiring – hiring of skilled craftspeople and apprentices living within SDUSD boundaries.
Board of Education Approval
The Board of Education approved the PSA on July 28, 2009.
Effective Date
Under the terms of the agreement, the PSA went into effect 90 days after the board approval. Therefore, the agreement was in effect Tuesday, October 27, 2009. The agreement stipulates that the PSA applies to work “advertised for bid” after the effective date.
Covered Work
The PSA governs construction if it is: 1) Propositions S, Z, U, work, and measures YY where added as addendums covering projects
where equal to or exceeding $1 million in value, based on the “construction cost estimate prior to the submittal of the individual project to the Division of State Architect,” 2) regardless
of estimated value –all State Bond funded projects and lease-lease back
projects are covered under the PSA and 3) Job
Order Contracts.
PSA Apprenticeship Program Upheld by Appellate Court
Recently (May 18), the California Court of Appeal rejected a legal challenge by the Associated General Contractors (AGC) to San Diego Unified School District’s Project Stabilization Agreement (PSA) with San Diego Building & Construction Trades Council and Southwest Regional Council of Carpenters. AGC challenged a requirement that bidders on construction projects must employ apprentices trained in the joint labor-management apprenticeship programs. In affirming the decision of the lower court, the Court of Appeal ruled that the requirement neither intrudes on the Division of Apprenticeship Standards’ regulatory power, nor violates any provisions of California’s Prevailing Wage Law. The court also ruled that public entities such as the district have the right to protect their own proprietary interests.
